١ - تسقط بالتقادم دعوى تكملة الثمن بمضي ثلاث سنوات من وقت توافر الأهلية أو من اليوم الذي يموت فيه صاحب العقار المبيع .
٢ - ولا تلحق هذه الدعوى ضررا بالغير حسن النية إذا كسب حقا عينيا على العقار المبيع .
