إذا تم إعذار الدائن ، تحمل تبعة هلاك الشىء أو تلفه ، ووقف سريان الفوائد ، وأصبح للمدين الحق فى إيداع الشىء على نفقة الدائن والمطالبة بتعويض ما أصابه من ضرر .
