إذا وفى حائز العقار المرهون كل الدين ، وحل محل الدائنين ، فلا يكون له بمقتضى هذا الحلول أن يرجع على حائز لعقار آخر مرهون فى ذات الدين إلا بقدر حصة هذا الحائز بحسب قيمة ما حازه من عقار .
