للمدين أن يتمسك قبل المحال له بالدفوع التى كان له أن يتمسك بها قبل المحيل وقت نفاذ الحوالة فى حقه ، كما يجوز له أن يتمسك بالدفوع المستمدة من عقد الحوالة .
