١ — لا يضمن المحيل يسار المدين إلا إذا وجد اتفاق خاص على هذا الضمان .
٢ — وإذا ضمن المحيل يسار المدين ، فلا ينصرف هذا الضمان إلا إلى اليسار وقت الحوالة ما لم يتفق على غير ذلك .
