١ — إذا صدر حكم على أحد المدينين المتضامنين ، فلا يحتج بهذا الحكم على الباقين .
٢ — أما إذا صدر الحكم لصالح أحدهم ، فيستفيد منه الباقون إلا إذا كان الحكم مبنيا على سبب خاص بالمدين الذى صدر الحكم لصالحه .
