إذا تسبب الدائن ، بسوء نية ، وهو يطالب بحقه ، فى إطالة أمد النزاع فللقاضى أن يخفض الفوائد قانونية كانت أو اتفاقية أو لا يقضى بها إطلاقا عن المدة التى طال فيها النزاع بلا مبرر .
