من أحدث ضررا وهو فى حالة دفاع شرعى عن نفسه أو ماله أو عن نفس الغير أو ماله ، كان غير مسئول ، على ألا يجاوز فى دفاعه القدر الضرورى ؛ وإلا أصبح ملزما بتعويض تراعى فيه مقتضيات العدالة .
