إذا كان العقد فى شق منه باطلا أو قابلا للإبطال ، فهذا الشق وحده هو الذى يبطل ، إلا إذا تبين من المقد ما كان ليتم بغير الشق الذى وقع باطلا أو قابلا للإبطال فيبطل العقد كله .
