١ — يقع باطلا تصرف المجنون والمعتوه ، إذا صدر التصرف بعد تسجيل قرار الحجر .
٢ — أما إذا صدر التصرف قبل تسجيل قرار الحجر فلا يكون باطلا إلا إذا كانت حالة الجنون أو العته شائعة وقت التعاقد ، أو كان الطرف الآخر على بينة منها .
