يشترط لنفاذ رهن المنقول فى حق الغير الى جانب انتقال الحيازة أن يدون العقد فى ورقة ثابتة التاريخ يبين فيها المبلغ المضمون بالرهن والعين المرهونة بيانا كافيا . وهذا التاريخ الثابت يحدد مرتبة الدائن المرتهن .
