١ - يضمن الراهن هلاك الشىء المرهون أو تلفه إذا كان الهلاك أو التلف راجعا لخطئه أو ناشئا عن قوة قاهرة .
٢ - وتسرى على الرهن الحيازى أحكام المادتين ١٠٤٨ و ١٠٤٩ المتعلقة بهلاك الشىء المرهون رهنا رسميا أوتلفه ، و بانتقال حق الدائن من الشىء المرهون إلى ما حل محله من حقوق .
