إذا هلك العقار المرهون أو تلف لأى سبب كان ، انتقل الرهن بمرتبته إلى الحق الذى يترتب على ذلك كالتعويض أو مبلغ التأمين أو الثمن الذى يقرر مقابل نزع ملكيته للمنفعة العامة .
§ ١ - بالنسبة إلى الدائن المرتهن :
