يجب على الوكيل أن يقرر حضوره عن موكله وأن يثبت وكالته عنه وفقا لأحكام قانون المحاماة وللمحكمة عند الضرورة أن ترخص للوكيل فى إثبات وكالته فى ميعاد تحدده على أن يتم ذلك فى جلسة المرافعة على الأكثر .
