كل إعلان أو تنفيذ يكون بواسطة المحضرين بناء على طلب الخصم أو قلم الكتاب أو أمر المحكمة ، ويقوم الخصم أو وكلاؤهم بتوجيه الإجراءات وتقديم أوراقها للمحضرين لإعلانها أو تنفيذها ، كل هذا ما لم ينص القانون على خلاف ذلك .
ولا يسأل المحضرون إلا عن خطئهم فى القيام بوظائفهم
