يجوز لمن يملك عقارا مقرورا عليه حق امتياز أو اختصاص أو رهن رسمى أو حيازى لم يحصل تسجيل تنبيه بنزع ملكيته أن يبيعه أمام القضاء بناء على قائمة بشروط البيع يودعها قلم كتاب المحكمة المختصة .
