إذا أمرت المحكمة ببيع العقار المملوك على الشيوع لعدم إمكان القسمة بغير ضرر يجرى بيعه بطريق المزايدة بناء على قائمة بشروط البيع يودعها قلم كتاب المحكمة الجزئية المختصة من يعنيه التعجيل من الشركاء .
