إذا لم يودع من يباشر الإجراءات قائمة شروط البيع خلال الخمسة والأربعين يوما التالية لتسجيل آخر تنبيه قام هو بإجرائه جاز للدائن اللاحق في التسجيل أن يقوم بإيداع القائمة ويحل محله في متابعة الإجراءات .
وعلى من يباشر الإجراءات أن يودع قلم الكتاب أوراق الإجراءات خلال ثلاثة الأيام التالية لإنذاره بذلك على يد محضر و إلا كان مسئولا عن التعويضات ولا ترد لمن يباشر الإجراءات مصاريف ما باشره منها إلا بعد إيقاع البيع .
