يحق للحاجز أن يمضى في التنفيذ إذا حكمت المحكمة بشطب الدعوى أو بوقفها عملا بالمادة ٩٩ أو إذا اعتبرت كأن لم تكن أو حكم باعتبارها كذلك كما يحق له أن يمضى في التنفيذ إذا حكم في الدعوى برفضها أو بعدم قبولها أو بعدم الاختصاص أو ببطلان صحيفتها أو بسقوط الخصومة فيها أو بقبول تركها ولو كان هذا الحكم قابلا للاستئناف .
