Article 351 of the Civil and Commercial Procedure Law

يجوز لقاضى التنفيذ في أية حالة تكون عليها الإجراءات أن يحكم بصفة مستعجلة في مواجهة الحاجز بالإذن للمحجوز عليه في قبض دينه من المحجوز لديه رغم الحجز وذلك في الحالات الآتية :
( ١ ) إذا وقع الحجز بغير سند تنفيذى أو حكم أو أمر .
( ٢ ) إذا لم يبلغ الحجز إلى المحجوز عليه في الميعاد المنصوص عليه في المادة ٣٣٢ أو إذا لم ترفع الدعوى بصحة الحجز في الميعاد المنصوص عليه في المادة ٣٣٣ .
( ٣ ) إذا كان قد حصل الإيداع والتخصيص طبقا للمادة ٣٠٢ .
