لمؤجر العقار أن يوقع في مواجهة المستأجر أو المستأجر من الباطن الحجز التحفظى على المنقولات والثمرات والمحصولات الموجودة بالعين المؤجرة . وذلك ضمانا لحق الامتياز المقرر له قانونا .
ويجوز له ذلك أيضا إذا كانت تلك المنقولات والثمرات والمحصولات قد نقلت بدون رضائه من العين المؤجرة ما لم يكن قد مضى على نقلها ثلاثون يوما .
