يجوز للمستأنف عليه إلى ما قبل إقفال باب المرافعة أن يرفع استئنافا مقابلا بالإجراءات المعتادة أو بمذكرة مشتملة على أسباب استئنافه .
فإذا رفع الاستئناف المقابل بعد مضى ميعاد الاستئناف أو بعد قبول الحكم قبل رفع الاستئناف الأصلى اعتبر استئنافا فرعيا يتبع الاستئناف الأصلى ويزول بزواله .
