إذا قدم المدعى عليه طلبا عارضا كان التقدير على أساس الأكبر قيمة من الطلبين : الأصلى أو العارض .
ومع ذلك إذا كان موضوع الطلب العارض تعويضات عن رفع الدعوى الأصلية أو عن طريق السلوك فيها فتكون العبرة بقيمة الطلب الأصلى وحده .
