يعتبر المتظلم فى حكم المدعى وتراعى عند نظر التظلم القواعد والإجراءات المتبعة أمام محكمة الدرجة الأولى .
و إذا تخلف المتظلم عن الحضور فى الجلسة الأولى لنظر التظلم تحكم المحكمة من تلقاء نفسها باعتبار التظلم كأن لم يكن .
