يجب على القاضى أن يصدر أمره بالكتابة على إحدى نسختى العريضة فى اليوم التالى لتقديمها على الأكثر .
ولا يلزم ذكر الأسباب التى بنى عليها الأمر إلا إذا كان مخالفا لأمر سبق صدوره فعندئذ يجب ذكر الأسباب التى اقتضت إصدار الأمر الجديد و إلا كان باطلا .
