متى حكم بسقوط الخصومة فى الاستئناف اعتبر الحكم المستأنف انتهائيا فى جميع الأحوال .
ومتى حكم بسقوط الخصومة فى التماس إعادة النظر قبل الحكم بقبول الالتماس سقط طلب الالتماس نفسه ، أما بعد الحكم بقبول الالتماس فتسرى القواعد السالفة الخاصة بالاستئناف أو بأول درجة حسب الأحوال .
