يقدم طلب الحكم بسقوط الخصومة إلى المحكمة المقامة أمامها الدعوى المطلوب إسقاط الخصومة فيها بالأوضاع المعتادة لرفع الدعوى .
ويجوز التمسك بسقوط الخصومة فى صورة دفع إذا عجل المدعى دعواه بعد انقضاء
المدة المنصوص عليها فى المادة ١٣٤ من هذا القانون.
ويكون تقديم الطلب أو الدفع ضد جميع المدعين أو المستأنفين و إلا كان غير مقبول .
