الدفع بعدم اختصاص المحكمة لانتفاء ولايتها أو بسبب نوع الدعوى أو قيمتها تحكم به المحكمة من تلقاء نفسها .
ويجوز الدفع به فى أية حالة كانت عليها الدعوى .
