لا تسرى أحكام هذا القانون على كل من سبق استثناؤه أو اعفاؤه نهائيا من الخدمة العسكرية وذلك فيما عدا الأفراد الذين يعاد عليهم الكشف الطبى مرة ثانية بالتطبيق لحكم المادة (١٢) .
أما من سبق اعفاؤه بصفة مؤقتة . وكذلك من أجل تجنيده فلا تسرى عليه أحكام هذا القانون الا من تاريخ زوال سبب الاعفاء أو التأجيل طبقا لنصوص القانون الذى عومل بمقتضاه .
