المؤسسون هم الذين يشتركون في إنشاء جمعية تعاونية ويوقعون عقد تأسيسها ويتولون إعداد نظامها الداخلي ويكونون مسئولين بالتضامن عما يرتبه إنشاء الجمعية من التزامات ومن كافة الأموال المكتتب بها لحين تسليمها لأول مجلس إدارة كما يرد إليهم ما تقرره الجمعية العمومية من مصروفات .
