يستثنى من تطبيق أحكام هذا الفصل ما يأتى :
( أ ) الأعمال العرضية .
(ب) الوظائف الرئيسية التى يعتبر شاغلوها وكلاء مفوضين عن أصحاب الأعمال .
وللوزير المختص أن يصدر قرارا بسريان أحكام هذا الفصل على كل أو بعض الأعمال والوظائف والفئات المشار إليها فى البندين السابقين .
