يجب أن يكون طلب التحكيم المقدم من صاحب العمل موقعا منه أو من وكيله المفوض .
فإذا كان الطلب من العمال وجب تقديمه من رئيس اللجنة النقابية - إن وجدت - أو من النقابة العامة المختصة ، وذلك كله بعد موافقة مجلس إدارة النقابة العامة .
وتتولى الجهة الإدارية المختصة إحالة ملف النزاع إلى هيئة التحكيم ، وذلك خلال يومين من تاريخ تقديم الطلب .
