إذا طرأت ظروف استثنائية غير متوقعة ترتب على حدوثها أن تنفيذ أحد الطرفين للاتفاقية أو لحكم من أحكامها أصبح مرهقا وجب على الطرفين سلوك طريق المفاوضة الجماعية لمناقشة هذه الظروف والوصول إلى اتفاق يحقق التوازن بين مصلحتيهما .
فإذا لم يصل الطرفان إلى اتفاق كان لأى منهما عرض الأمر على الجهة الإدارية المختصة لاتخاذ ما يلزم نحو اتباع إجراءات الوساطة وفقا لأحكام المادة (١٧٠) من هذا القانون .
