إذا رفضت الجهة الإدارية المختصة قيد الاتفاقية وفق أحكام المادة السابقة جاز لكل من طرفى الاتفاقية اللجوء إلى المحكمة الابتدائية التى يقع بدائرتها محل العمل بطلب القيد وفق الإجراءات المعتادة لرفع الدعوى ، وذلك خلال ثلاثين يوما من تاريخ الإخطار بالرفض .
فإذا قضت المحكمة بقيد الاتفاقية وجب على الجهة الإدارية المختصة إجراء القيد فى السجل الخاص ونشر ملخص الاتفاقية فى الوقائع المصرية بلا مصروفات .
