يتعين على طرفى الاتفاقية سلوك طريق المفاوضة الجماعية لتجديدها قبل انتهاء مدتها بثلاثة أشهر ، فإذا انقضت المدة الأخيرة دون الاتفاق على التجديد امتد العمل بالاتفاقية مدة ثلاثة أشهر ويستمر التفاوض لتجديدها ، فإذا انقضى شهران دون التوصل إلى اتفاق كان لأى من طرفى الاتفاقية عرض الأمر على الجهة الإدارية المختصة لاتخاذ ما يلزم نحو اتباع إجراءات الوساطة وفقا لأحكام المادة (١٧٠) من هذا القانون .
