اذا رعت دعوى علي القاصر او المحجور عليه او الغائب من وارث اخر جاز للمحكمة بناء علي طلب من ينوب عنه او بناء علي طلب النيابة العامة ان توقف القسمة مدة لا تجاوز خمس سنوات اذا ثبت لها ان في التعجيل بها ضررا جسيما .
