يجوز للاب ان يكون وصيا مختارا لولدة القاصر او للحمل المستكين ويجوز ذلك للمتبرع في حالة المنصوص علية في المادة 3 .
ويشترط ان يثبت الاختيار بورقة رسميه او عرفية مصدق علي توقيع الاب او المتبرع فيها او المكتوب بخطة وموقعة بامضائه .
ويجوز للاب المتبرع بطريق الوصيه في اى وقت ان يعدل عن اختيارهما وتعرض الوصيه علي المحكمة لتثبيتها .
