يعاقب بالأشغال الشاقة المؤقتة وبغرامة لا تقل عن خمسة آلاف جنيه ولا تزيد على خمسين ألف جنيه كل من قام بتهريب أثر إلى خارج الجمهورية أو اشترك فى ذلك . ويحكم فى هذه الحالة بمصادرة الأثر محل الجريمة وكذلك الأجهزة والأدوات والآلات والسيارات المستخدمة فيها لصالح الهيئة .
