لا يجوز محو القيد إلا بمقتضى حكم نهائي أو برضاء الدائن بتقرير رسمي منه ومع ذلك يكتفي في إجراء المحو في حالة رهن الحيازة العقاري وحقوق الامتياز العقارية بإقرار عرفي مصدق علي التوقيع فيه.
