إذا لم يتيسر إتمام الإجراءات الخاصة بالطلب الأسبق بسبب نقص أو عيب في البيانات أو الأوراق أخطر صاحب الشأن بكتاب موصى عليه مصحوب بإخطار وصول لتلافي هذا النقص أو العيب، خلال أجل لا يجاوز خمسة عشر يوما فإذا لم يفعل رفع الأمر إلي أمين مكتب الشهر وللأمين أن يصدر قرارا مسببا بسقوط أسبقية هذا الطلب أو بوقف الإجراءات الخاصة بالطلبات التالية علي حسب الأحوال.
ويراعي في إبلاغ القرار الصادر بسقوط الأسبقية وفي إعادة الطلبات اللاحقة للطلب الذي تقرر سقوطه القواعد المقررة في المادة السابقة.
