تعد في حكم الشركات المصرية المنصوص عليها في المادة السابقة وتخضع للضريبة المقررة فيها :
(١) كل شركة أجنبية يكون مقرها الرئيسى في جمهورية مصر العربية ولو شمل نشاطها بلاد أخرى .
(ب) كل شركة أجنبية يكون غرضها الوحيد أو غرضها الرئيسى الاستثمار في جمهورية مصر العربية ولو كان مقرها في الخارج .
(ج) فروع الشركات والبنوك الأجنبية المخصص لنشاطها في جمهورية مصر العربية رأس مال محدد .
