تختص محكمة الإفلاس بنظر جميع الدعاوى الناشئة عن التفليسة والدعاوى التى للتفليسة على الغير أو للغير عليها .
وتعتبر الدعوى ناشئة عن التفليسة على وجه الخصوص إذا كانت متعلقة بأموالها أو بإدارتها أو بموجوداتها أو كان الفصل فيها يقتضى تطبيق أحكام هذا القانون .
