استثناء من أحكام المواد (٤، ٥، ٩، ١٠، ١١) من هذا القانون إذا طلبت النيابة العامة شهر إفلاس التاجر ، أو إذا رأت المحكمة شهر إفلاسه من تلقاء ذاتها ، وجب على قلم الكتاب أن يعلنه بيوم الجلسة .
وفى حالة وفاة التاجر أو اعتزاله التجارة لا يجوز للمحكمة أن تنظر فى شهر الإفلاس بناء على طلب النيابة العامة بعد انقضاء السنة التالية لوفاته أو اعتزاله التجارة .
