يشترط لانعقاد جلسات الوساطة حضور أطراف النزاع أو وكيل عنهم بموجب توكيل خاص يبيح له تسوية النزاع .
ويجوز لقاضى الإفلاس أن يجرى الوساطة بالطريقة التى يراها مناسبة مع مراعاة طلبات الأطراف وظروف الوساطة ، وله فى ذلك الاجتماع مع أطراف النزاع أو وكلائهم أو الانفراد بكل طرف على حدة ، واتخاذ ما يراه مناسبا لتقريب وجهات النظر بهدف الوصول إلى اتفاق تسوية ملزم للطرفين .
