استثناء من حكم المادة (٦٥) من هذا القانون إذا قضت المحكمة برفض الاعتراض المقدم من المدين ، أو برفض التصديق على الصلح ، أو بإنهاء إجراءات الصلح وثبت توقف المدين عن الدفع ، وجب عليها أن تقضى من تلقاء نفسها فى ذات الحكم بشهر إفلاسه ، وذلك دون إخلال بحق ذوى الشأن فى الطعن على الحكم بشهر الإفلاس .
