فى حالة كون عقار المفلس مسجلا ، يقوم أمين اتحاد الدائنين بإعلان القرار الصادر
من قاضى التفليسة باتخاذ إجراءات البيع إلى مكتب الشهر العقارى أو إلى مكتب السجل
العينى المختص للتأشير به بغير رسوم خلال مدة لا تجاوز أسبوعا من تاريخ إعلانهما على
هامش سند ملكية المدين المفلس للعقار ، أو بصحيفة الوحدة العقارية مباشرة بحسب الأحوال ،
وإعلان ذلك إلى جميع الدائنين المقيدة حقوقهم على العقار وإلى حائزه الفعلى .
