يجوز لدائن الشركة طلب شهر إفلاسها ولو كان شريكا فيها ، أما الشركاء غير
الدائنين فلا يجوز لهم بصفتهم الفردية طلب شهر إفلاس الشركة .
وإذا طلب الدائن شهر إفلاس الشركة ، وجب اختصام كافة الشركاء المتضامنين .
