تعد فى حالة إفلاس كل شركة توقفت عن دفع ديونها إثر اضطراب أعمالها المالية ،
ويلزم شهر إفلاسها بحكم يصدر بذلك .
ويجوز شهر إفلاس الشركة ولو كانت فى دور التصفية .
