لا يجوز تسليم الدفاتر التجارية إلى أمين التفليسة إلا بعد أن يقوم قاضى التفليسة بإقفالها .
ويدعى المفلس إلى حضور جلسة إقفال الدفاتر التجارية ، فإذا لم يحضر أقفلت الدفاتر بغير حضوره .
ولا يجوز للمفلس أن ينيب عنه غيره لحضور جلسة إقفال الدفاتر إلا لأسباب يقبلها قاضى التفليسة .
