يجوز لأمين التفليسة وحده أو بناء على طلب قاضى التفليسة أن يطلب عدم نفاذ تصرفات المدين فى حق جماعة الدائنين إذا وقع التصرف قبل صدور حكم شهر الإفلاس وذلك وفقا لأحكام القانون المدنى ، ويسرى الحكم الصادر بعدم نفاذ التصرف فى حق جميع الدائنين سواء نشأت حقوقهم قبل حصول التصرف أو بعد حصوله .
